Terms of Service

1. Acceptance of Terms

Welcome to Rudderberry. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service. These Terms constitute a legally binding agreement between you and Rudderberry ("we," "us," or "our").

2. Description of Service

Rudderberry is a personalized children’s book creation service that uses artificial intelligence to generate custom illustrated storybooks and coloring books. Users provide details about a child, and our AI systems generate a unique story and accompanying illustrations. Users can review and request revisions to both the story text and illustrations before finalizing their purchase. We offer digital PDF downloads and printed book options (paperback and hardcover) fulfilled through third-party print partners.

Rudderberry+ Membership: We offer an optional paid membership that provides benefits including discounts on book purchases, additional revision allowances, priority generation queue, exclusive art styles, voice narration for storybooks, and the Family Library feature.

Voice Narration: Members can record their voice (or invite family members to record theirs) to create personalized audio narration for storybooks. See Section 7 for full details.

Family Library: Members can pair devices so children can independently read their books in a safe, read-only reading experience. See Section 4 for full details.

3. Account Registration

To create an account and use our service, you must:

  • Be at least 18 years of age, or at least 13 years of age with verifiable consent from a parent or legal guardian who agrees to these Terms on your behalf
  • Provide accurate, current, and complete information
  • Maintain and update your account information to keep it accurate
  • Keep your account credentials secure and confidential
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Children under 13 may not create accounts. Rudderberry accounts are intended for parents, guardians, family members, and educators. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Children's Privacy & Family Library (COPPA)

Rudderberry complies with the Children's Online Privacy Protection Act (COPPA). Our service is designed for adults to create personalized books for children. All information about a child is provided by an authenticated parent or guardian — children never enter personal information themselves.

Family Library: Rudderberry offers a Family Library feature that allows parents to pair devices so children can independently read their books in a read-only interface. When using the Family Library:

  • No personal information is collected from children. The reading interface contains no forms, text inputs, or other data collection mechanisms.
  • All product analytics and tracking technologies are completely disabled on child-facing pages. No pageview events, click tracking, or behavioral data is collected.
  • The cookie consent banner is not shown to children, as children cannot provide valid consent for analytics tracking.
  • No advertisements or external links are displayed.
  • Parents can revoke access to any paired device at any time from their account settings.

By creating a child profile and providing information about your child, you represent that you are the child's parent or legal guardian (or have authorization from one) and consent to the collection and use of such information as described in our Privacy Policy.

Parents may review, modify, or delete their child’s information at any time through their account settings, or by contacting us at privacy@rudderberry.com. For full details on our children’s privacy practices, see Section 3 of our Privacy Policy.

5. User Content & Responsibilities

You are solely responsible for all information, text, and details you provide to our service ("User Content"). By submitting User Content, you represent and warrant that:

  • You have the legal authority to share information about the child featured in the book
  • Your User Content does not violate any applicable laws or regulations
  • Your User Content does not contain harmful, offensive, defamatory, obscene, or otherwise inappropriate material
  • Your User Content does not infringe upon any third-party intellectual property rights
  • You will not use our service to create content that promotes illegal activities, violence, discrimination, or hate speech

We reserve the right to review and remove any User Content that violates these Terms or is otherwise objectionable in our sole discretion.

6. AI-Generated Content

Our service uses artificial intelligence to generate story text and illustrations. By using our service, you acknowledge and agree that:

  • Content is generated by AI algorithms and results may vary
  • We do not guarantee specific outcomes, artistic styles, or narrative structures
  • AI-generated content should be reviewed by you before finalizing your purchase
  • You have the opportunity to request revisions before approving the final book
  • While we strive for age-appropriate content, you should review the generated book to ensure it meets your standards
  • We are not responsible for any interpretation or reaction to the AI-generated content

You agree to exercise reasonable judgment when reviewing AI-generated content before finalizing your purchase.

7. Voice Narration Features

Rudderberry+ members may record their voice or invite family members to record their voice to create personalized narration for storybooks. By using the voice recording feature, you acknowledge and agree that:

Consent & Biometric Data:

  • Voice recordings may constitute biometric data under applicable laws, including the Illinois Biometric Information Privacy Act (BIPA), the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA)
  • You must provide affirmative consent before recording begins, and your consent will be timestamped and stored
  • Your voice recording will be processed by ElevenLabs, a third-party voice technology provider, solely for the purpose of creating narration for storybooks
  • Your voice data will not be sold, shared with advertisers, or used for any purpose other than storybook narration

Family Voice Invitations:

  • Members may invite family members to contribute their voice via a secure, single-use invite link that expires after 7 days
  • Invited recorders do not need a Rudderberry account — their voice clone is created under the inviting member’s account
  • The inviting member is responsible for ensuring they have the invited person’s agreement to share the invite link
  • Invited recorders must provide their own consent before recording

Deletion Rights:

  • Account holders can delete any voice clone at any time from their account settings
  • Invited recorders can delete their voice at any time via the manage link in their confirmation email, or by contacting us at privacy@rudderberry.com
  • Deletion permanently removes the source recording from our storage and the voice clone from our third-party provider’s systems

8. Intellectual Property

Upon completion of your purchase, you receive a personal, non-exclusive, non-transferable license to the generated book content, subject to the following terms:

What you CAN do:

  • Print copies of the book for personal use or as gifts
  • Share the digital PDF with immediate family members
  • Display or share images from the book on personal social media (non-commercial)

What you CANNOT do:

  • Resell, redistribute, or commercially exploit the generated content
  • Use the content for any commercial purposes without prior written consent
  • Claim authorship or ownership of the AI-generated content
  • Modify the content and redistribute it as your own work
  • Use the content to train other AI systems

Rudderberry retains all underlying intellectual property rights to our AI systems, generation processes, branding, and technology. The Rudderberry name, logo, and all related marks are trademarks of Rudderberry and may not be used without permission.

9. Pricing & Payment

Storybooks:

  • Digital PDF: $39
  • Paperback + Digital PDF: $58
  • Hardcover + Digital PDF: $68

Coloring Books:

  • Digital PDF: $19
  • Paperback + Digital PDF: $34
  • Hardcover + Digital PDF: $54

Rudderberry+ Membership:

  • Monthly: $4/month
  • Annual: $39/year

Revision Packs:

  • 10 revisions: $3
  • 20 revisions: $5

Rudderberry+ members receive a 20% discount on all book purchases.

All payments are processed securely through Stripe. By making a purchase, you agree to provide current, complete, and accurate payment information. Prices are subject to change at any time, but changes will not affect orders already placed or active subscriptions until their next renewal. All prices are in USD unless otherwise specified. You are responsible for any applicable taxes, duties, or customs fees.

10. Refund Policy

Due to the personalized and custom nature of our products, our refund policy is as follows:

Digital Products (PDF):

Refund requests for digital products will be considered on a case-by-case basis. Since you have full revision control and must approve the final book before completing your purchase, refunds are generally not provided for buyer's remorse after you have approved and downloaded the final PDF. If you experience technical issues preventing download or if the delivered file is corrupted, please contact us immediately and we will resolve the issue or provide a refund.

Printed Products (Paperback/Hardcover):

We will provide refunds or replacements for printed books that arrive with printing defects, manufacturing errors, or shipping damage. Please contact us within 14 days of receipt with photographic evidence. We are not responsible for buyer's remorse on books that were finalized and approved by you before printing. Once a book has been sent to our print partner, the order cannot be cancelled.

Memberships (Rudderberry+):

You may cancel your Rudderberry+ membership at any time from your account settings. Upon cancellation, you will retain access to membership benefits through the end of your current billing period. No prorated refunds are provided for partial billing periods. If you believe you were charged in error, please contact us.

To request a refund, please contact us at support@rudderberry.com with your order number and detailed explanation.

11. Delivery

Digital Products: Digital PDF downloads are available immediately upon completion and approval of your book. Books are stored in your account library and can be downloaded at any time while your account is active.

Printed Products: Printed books are fulfilled by third-party print partners and shipped to the address you provide. Shipping times vary by location and typically range from 5-15 business days for domestic orders. International shipping may take longer. We are not responsible for delays caused by shipping carriers, customs processing, or events beyond our control. Tracking information will be provided when available.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
  • We do not warrant that the service will be uninterrupted, error-free, or secure
  • We are not liable for the accuracy, appropriateness, or quality of AI-generated content
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims related to our service is limited to the amount you paid for the specific book in question
  • We are not responsible for how recipients react to or interpret the personalized books
  • We are not liable for third-party services, including payment processors and shipping carriers

Some jurisdictions do not allow limitations on implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in full.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rudderberry and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of our service; (b) your violation of these Terms; (c) your User Content or any information you provide; (d) your violation of any rights of another party; or (e) any harm or offense caused by books created through our service.

14. Termination

We reserve the right to suspend or terminate your account and access to our service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may delete your account at any time by contacting us. Upon termination, your right to use the service will immediately cease. Previously purchased books and licenses granted for completed purchases will remain valid.

15. Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Informal Resolution: If you have any dispute with us, you agree to first contact us at support@rudderberry.com and attempt to resolve the dispute informally. We will attempt to resolve any disputes in good faith.

Binding Arbitration: If we cannot resolve a dispute informally, any remaining dispute will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules. You and Rudderberry agree to waive the right to a trial by jury or to participate in a class action.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. We will notify users of material changes via email or through a prominent notice on our website. Your continued use of the service after such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you should discontinue your use of the service.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
